Spousal Maintenance

Maintenance (referred to as Periodical Payments in any court or legal documents) is intended to make provision for one of the parties to a dissolution of a civil partnership to receive a regular weekly or monthly payment from the other party.

An agreement or order for Periodical Payments can be made in isolation or addition to a lump sum payment or a transfer of property.

Interim Maintenance

It is possible for one party to the dissolution of a civil partnership to obtain maintenance from the other to assist them in meeting their needs whilst the dissolution process is ongoing and prior to any final financial agreement or order being made. This is commonly known as maintenance pending suit.

Whether it is interim maintenance provision or a final Periodical Payment order, the key factors that need to be considered are:

  • who is able to apply for an order and when
  • should an order for periodical payments be made at all
  • if so, what should the amount of the order be
  • should any order be limited in time
