Specific Issue Order

A Specific Issue Order is an order which deals with a specific question or issue which may arise in connection with a child that the parents or a person with Parental Responsibility are unable to agree on.

In our experience a Specific Issue Order is often used to decide:

  • which school a child should attend
  • whether a child should have a particular operation or course of treatment
  • which religion the child should follow

What will the court consider ?

When a court is considering whether to make a Specific Issue Order it will take into consideration the following factors :-

  • What is in the childs best interests
  • The wishes and feelings of the child
  • The effect on the child of any change in their circumstances
  • Any harm the child has suffered or is at risk of suffering
  • The child's, physical, emotional and educational needs
